Welcome to ClassForward.com! Your privacy is extremely important to us. Accordingly, we have developed this Policy in order for you to understand how we collect, use, communicate, disclose and make use of personal information. The Privacy Policy is part of and incorporated into our Terms of Use. Autumnate will not change how information is collected, used, or shared under the terms of this Agreement in any way without advance notice to you.

1: What This Privacy Policy Covers

This Privacy Policy covers the products, content, functionality, and services provided through Autumnate, Inc.'s websites, including those located at app.classforward.com and www.classforward.com. It describes how Autumnate handles your Information – that is, any non-public data we collect or receive from you through the Service.

This Privacy Policy relates to the following types of Information:

Personally Identifiable Information or "PII": any Information that can be used to identify a specific person, or any anonymous information (such as an IP address) that can be linked to a specific person with additional data.

Childrens' Personal Information: any PII that can be used to identify a person under the age of 18.

De-Identified Information: any Information that was at one point PII or Children's Personal Information, but has had all direct and indirect personal identifiers removed. Identifiers include, but are not limited to, name, unique numbers such as social security numbers, date of birth, demographic information, location information, and school information.

2 Basic Privacy Policy

We are committed to protecting your privacy and the privacy of third parties. We will not sell, exchange, or otherwise share Information with third parties without your express permission, except as provided in this Privacy Policy and/or the Terms of Use.

3 Information We Collect

3.1 Personal Information

Autumnate may ask you for Information in order to provide the Service to you. For example, when you create an account, you will be asked provide certain information, some of which is mandatory and some of which is optional. Types of Information you may be asked to provide include your first and last name, email address, profile picture, username, password, and/or billing and payment information. You may add, delete, or modify your personal information at any time.

At times, we may ask you to provide additional Information so that we may better respond to your questions, inquiries, and other communications. Autumnate will treat any Information you provide during such contacts as PII. However, such information may not be deleted from our records even if you delete the same information from your account.

3.2 User Submissions

As part of using the Service, you may add, create, upload, submit, distribute, collect, or post content, videos, audio clips, written comments, data, text, photographs, drawings, software, scripts, graphics, interactive features, or other information . Autumnate recognizes that User Submissions may contain Children's Personal Information, which is governed by specific policies described below. See the Terms of Service for more details on your rights and responsibilities regarding User Submissions.

3.3 Usage Data

Autumnate may collect Information on how you use the Service, including your IP address, page requests, time and duration of your visit, and your interactions with the elements of the Service.

4 How we use your Information

Autumnate generally uses Information, including PII and Children's Personal Information, as necessary to provide a functional Service. Additionally, we may use your Information in the following specific ways.

4.1 Email

If you have supplied us with your email address, we may occasionally send you an email to tell you about new features, ask for your feedback, or just keep you up to date with what's going on with ClassForward. We abide by all regulations governing email contact, including the CAN-SPAM Act.

If you would prefer not to receive marketing or promotional e-mails from us that may relate, for example, to new services or offerings, you may opt-out of receiving these communications by using the opt-out mechanism in an email or contacting us at [email protected]. Please note that we may continue to contact you via email for administrative or informational purposes, including, but not limited to, follow-up messages regarding the administration of your account, any services, features or functions you have affirmatively enrolled in or registered to use, changes to our Terms of Use or this Privacy Policy, or to confirm certain transactions made through the Service.

4.2 Advertising

Autumnate may use your Information to suggest products or services to users. Autumnate will never use your Information to advertise or market to students or their parents, and will never use Children's Personal Data  for any type of advertising.

4.3 Research and Development

Autumnate may use your Information for product development, research, or other purposes. Any Personally Identifiable Information or Children's Personal Data will be de-identified prior to use. We will not attempt to re-identify De-identified Information, and will use all reasonable efforts to ensure that re-identification is not possible.

4.4 Legal Compliance and Protections

Autumnate may use your Information to prevent, detect, mitigate, and investigate fraudulent or illegal activity, including violations of the Terms of Service, and to defend itself in any action arising out of the Service.

5 How We Share Your Information

We will not rent or sell Personally Identifiable Information or Children's Personal Information to anyone without consent. However, we may share Information, including Personally Identifiable Information and/or Children's Personal Information, without prior consent under certain circumstances.

5.1 Course of Business

Autumnate reserves the right to share Information with our successors, subsidiaries, or assigns. We may also share Information with companies and organizations that (i) need to know that information to perform services on our behalf (including companies that provide data management or other support services to us, such as data storage and Web hosting services as delineated in the Family Educational Right to Privacy Act), and (ii) have agreed not to disclose it to others.

Additionally, Information that you provide or that we collect may be transferred to another company that has acquired our stock or assets, for example, as a result of a sale, merger, reorganization, dissolution, or liquidation. If such a transfer occurs, the acquiring company's use of your Information will still be subject to this Privacy Policy and the privacy preferences you have expressed to us. In the event the acquiring company wishes to materially change this Privacy Policy, it will not do so without giving you notice and an opportunity to remove your Information from the Service.

5.2 Within the Service

Information that you have provided to the Service may be shared with other users based on your privacy settings. Additionally, depending on your account settings, some of your PII (such as your account name) may be displayed to other users when you upload User Submissions, send messages, or otherwise use the Service. We cannot control what other users will do with your Information after you have shared it. Some privacy settings may be set by your organization, and you should review them before sharing any information.

5.3 De-Identified Information

Autumnate may share De-identified Information with our affiliates for product development and research purposes. However, we will not share De-identified Information with any party unless that party agrees not to attempt re-identification.

5.4 Legal Compliance and Protection

We may disclose Personally Identifiable Information when we have a good faith belief that disclosure is appropriate to: (i) comply with applicable law (or a court order or subpoena); (ii) prevent or investigate a possible crime, such as fraud or identity theft; (iii) enforce the Terms of Use or other agreements that govern your use of the Service; or (iv) protect the rights, property or safety of us, our users, or others.

6 How We Store And Protect Your Information

Any Information collected through the Service is stored and processed in the United States. If you use our Service outside of the United States, you consent to have your Information transferred to the United States.

Access to Information is protected via user authentication and is limited to those employees who require it to perform their job functions. We use industry-standard Secure Socket Layer (SSL) encryption technology to safeguard all use of the Service. Other security safeguards include but are not limited to data encryption, firewalls, and physical access controls to building and files.

Personally Identifiable Information and Children's Personal Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. All transactions are processed through a gateway provider and are not stored or processed on our servers.

7 Special Considerations for Children's Personal Information

Because of the nature of the Service, you and other users may provide and/or have access to Children's' Personal Information. Because of the sensitive nature of such Information, it is governed by several special regulations.

7.1 COPPA ("Children Online Privacy Protection Act")

COPPA, 15 U.S.C. §§6501 et seq., regulates the collection of PII from children under 13. The Federal Trade Commission, the nation's consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children's privacy and safety online.

Autumnate does not permit users under 18 to create accounts or provide PII, nor do we knowingly collect PII from children under the age of 18. Because children under 18 are not permitted to use the Service, Children's Personal Information will only be provided as part of a User Submission by another user. Pursuant to the Terms of Use, all users are required to secure parental consent prior to providing PII for any child or student, including children under the age of 13.

If we learn that PII has been provided for or by a child under 13 without parental consent, we will remove it promptly.

7.2 Family Educational Rights and Privacy Act ("FERPA")

FERPA, 20 U.S.C. § 1232g and 34 CFR Part 99, protects the privacy of student education records. It prohibits schools from disclosing educational records without consent, except in specific circumstances. It also gives students and parents certain rights to access and correct education records.

Autumnate is not a "School Official" under FERPA. Accordingly, Autumnate can only access educational records with the consent of the student (if the student is 18 years old or older) or the student's guardian (if the student is under 18 years of age). Pursuant to the Terms of Use, all users are required to secure parental consent prior to providing educational records for any child. Because Autumnate is not a school official, all requests by parents or students to review or correct student records should be made directly to the responsible school official.

Although Autumnate and the Service are not directly subject to FERPA, we endeavor to provide a high level of privacy and security for student information, and make it easier for teachers, administrators, and other school officials to maintain FERPA compliance. Autumnate will not disclose any educational record without prior consent from a student or guardian, as permitted under 34 CFR §99.33(b) and (c). Generally, this permits disclosures that are necessary to provide the Service and disclosures that are required by law, such as responses to subpoenas.

8 Cookies

Many modern interactive websites use cookies to enable service providers to retrieve user details for each visit. Autumnate uses cookies to enable the functionality of the Service. We do not use cookies for tracking purposes, however, third-party advertisers may do so. We honor do-not-track signals and do not track, plant cookies, or use advertising when a Do-Not-Track (DNT) browser mechanism is in place. By using the Service, you consent to the use of cookies in accordance with this Provision.

You may set your browser to reject some or all cookies. However, if you do so, you may not be able to access certain features or services of the Site.

9 Links To Other Websites And Services

We are not responsible for the practices employed by websites, applications, or services linked to or from our Service. We recommend that you review the privacy policies of other applications before authorizing a third party to access data through the Service.

10 Miscellanous

This Privacy Policy complies with the provisions of the California Online Privacy Protection Act (CalOPPA).

11 Changes To Our Privacy Policy

Autumnate may modify or update this Privacy Policy from time to time, so you should review this page periodically. If we change the Policy in a material manner, for example if we seek to use personal information in a materially different way than we had previously, we will provide at least 30 days notice so that you have sufficient time to evaluate the change in practice. Of course, you can always opt-out by deleting your account before the changes take effect.
